Agreement to these terms

These Terms of Use (“Terms”) govern your access to and use of the website at helpal-inc.com (the “Site”), operated by Helpal Inc. (“Helpal”, “we”, “us”, “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

About the Site

The Site is an informational website presenting our company and our apps. It does not itself provide the apps: each app is distributed through the relevant app store and governed by its own terms.

Eligibility

The Site is intended for a general audience and is not directed to children. By using it you represent that you can form a binding contract in your jurisdiction, or that you use it under the supervision of a parent or guardian who agrees to these Terms.

Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable permission to use the Site for personal, non-commercial purposes.

You agree not to use the Site unlawfully; copy, scrape, or systematically extract its content except as permitted; attempt to gain unauthorised access to it or disrupt it; introduce malware; or misrepresent your identity or affiliation.

Our apps and the app stores

Links on the Site direct you to our apps on the Apple App Store. Downloading and using an app is subject to that app’s own terms and privacy policy, and to the store’s terms — including Apple’s standard Licensed Application End User License Agreement. We are not responsible for the stores themselves.

Some of our apps are developed in collaboration with Bonolota, a separate company: Helpal Inc. publishes the iOS versions on the App Store, and Bonolota publishes the Android versions on Google Play under its own account. Each store listing identifies its publisher.

Intellectual property

The Site and its content — text, graphics, logos, the Helpal name and mark, product names, and design — are owned by us or our licensors and protected by intellectual-property laws. Except for the limited permission described above, no rights are granted to you. Third-party names and marks belong to their owners.

Third-party links and services

The Site links to third-party sites and services we do not control, including the App Store, Bonolota’s site, and QuickEase’s site. We are not responsible for their content, policies, or practices, and you access them at your own risk.

Disclaimers

The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that its information is complete or current.

App details — features, availability, and pricing — are set by the store listing, which takes precedence over anything written here. Apps described as in development are not released, and nothing on this Site is a commitment that they will be.

Limitation of liability

To the maximum extent permitted by law, Helpal Inc. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of — or inability to use — the Site. Nothing here excludes liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold Helpal Inc. harmless from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Changes to the Site and to these Terms

We may modify or discontinue the Site at any time. We may also update these Terms: we will revise the date at the top of this page and, for material changes, give a more prominent notice. Continued use after a change takes effect constitutes acceptance.

Termination

We may suspend or restrict your access at any time if you breach these Terms, or for any other lawful reason. Provisions that by their nature should survive — intellectual property, disclaimers, and limitation of liability — will survive.

Governing law and jurisdiction

These Terms are governed by the laws of Pakistan, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts of Pakistan, subject to any mandatory consumer-protection rights you have in your country of residence.

General

If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Site. You may not assign them without our consent; we may assign them in a business transfer.
